Midori DMCA Policy
Midori ("we", "us", or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Midori will respond expeditiously to claims of copyright infringement committed using the Midori service if such claims are reported to Midori's Designated Copyright Agent identified below.
Filing a DMCA Takedown Notice
If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Midori service, please submit a written notice ("DMCA Takedown Notice") to our Designated Copyright Agent containing the information listed below. Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed.
- Identification of the infringing material: A description of where the material that you claim is infringing is located on the Midori service, with enough detail that we may find it (e.g., URL).
- Your contact information: Your name, address, telephone number, and email address.
- Statement of good faith belief: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- Statement under penalty of perjury: A statement that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf, made under penalty of perjury.
- Signature: An electronic or physical signature of the copyright owner or a person authorized to act on their behalf.
Filing a DMCA Counter-Notification
If you believe that your material has been removed or disabled by mistake or misidentification, you may submit a written counter-notification ("DMCA Counter-Notification") to our Designated Copyright Agent containing the information listed below. Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability for damages.
- Identification of removed material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- Your contact information: Your name, address, telephone number, and email address.
- Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Midori may be found.
- Acceptance of service: A statement that you will accept service of process from the person who provided the original notification of infringement or an agent of such person.
- Signature: Your electronic or physical signature.
